By accessing or using WellWhisker (“the Service,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. The Service is operated by WellWhisker LLC, a Washington limited liability company.
WellWhisker provides pet wellness tools including recipe management, food ingredient analysis, wellness tracking, health journaling, and nutrition planning for dogs and cats. The Service provides general educational and informational content only. The Service does NOT constitute veterinary medical advice, diagnosis, or treatment. No information provided by the Service should be interpreted as a medical diagnosis, treatment recommendation, or prescription.
WellWhisker is NOT a veterinary service and does NOT provide veterinary medical advice, diagnosis, or treatment. All content, including ingredient analysis, recipes, and wellness suggestions, is provided for general educational and informational purposes only and should never be used as a substitute for professional veterinary advice. We do not diagnose conditions, prescribe medications, or recommend specific treatments.
Always consult a licensed veterinarian before making any changes to your pet’s diet, medications, or care regimen, and before acting on any information provided by the Service.
IN CASE OF A VETERINARY EMERGENCY, CONTACT A LICENSED VETERINARIAN OR EMERGENCY ANIMAL HOSPITAL IMMEDIATELY. DO NOT USE THE SERVICE FOR EMERGENCY SITUATIONS.
By using WellWhisker, you acknowledge and agree that you will not rely on the Service for medical decisions and that WellWhisker bears no liability for any actions taken based on the information provided.
You must provide accurate information when creating an account and keep your information updated. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian to use the Service.
WellWhisker offers a 7-day free trial of WellWhisker Pro. After the trial period, your subscription will automatically renew at $4.99/month or $29.99/year (equivalent to $2.49/month billed annually), unless cancelled at least 24 hours before the end of the current period. Payment is charged to your Apple ID account, Google Play account, or payment method on file at confirmation of purchase. Prices may vary by region and are subject to change; current pricing is displayed in the app at purchase.
Subscriptions can be managed and auto-renewal turned off in your Apple Account Settings, Google Play subscription settings, or through your web account. Free accounts have limited access to recipes and features. Refunds are handled according to the policies of the respective app store. Web subscription refunds are handled on a case-by-case basis by contacting hello@wellwhisker.app.
You retain ownership of content you upload to the Service, including photos, health data, journal entries, and recipes (“User Content”). By uploading User Content, you grant WellWhisker a worldwide, non-exclusive, royalty-free license to host, store, process, display, and use the User Content solely to provide the Service to you. You represent and warrant that you have the rights necessary to upload any User Content, including any copyrighted material. We do not sell your personal data to third parties.
You agree not to: (a) misuse the Service or interfere with its operation; (b) attempt to gain unauthorized access to the Service, other user accounts, or our systems; (c) use automated tools, scrapers, or bots to access the Service beyond normal use; (d) upload content that is unlawful, infringing, harmful, harassing, or violates any third party’s rights; (e) reverse engineer, decompile, or attempt to derive the source code of the Service; (f) use the Service to provide veterinary advice to others as if you were a licensed veterinarian; or (g) use the Service in violation of any applicable law or regulation.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WELLWHISKER DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION OBTAINED THROUGH THE SERVICE WILL BE ACCURATE OR RELIABLE. YOU ACKNOWLEDGE THAT INFORMATION GENERATED BY THE SERVICE MAY CONTAIN ERRORS AND SHOULD NOT BE SOLELY RELIED UPON FOR PET HEALTH, NUTRITION, OR CARE DECISIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WELLWHISKER LLC, ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO WELLWHISKER IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to defend, indemnify, and hold harmless WellWhisker LLC and its officers, members, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third party’s rights.
We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Service. You may delete your account at any time through account settings or by contacting hello@wellwhisker.app. Sections 6, 8, 9, 10, 12, 13, and 14 survive termination.
These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law principles. Subject to the arbitration provision in Section 13, any legal action arising from these Terms or the Service that is not subject to arbitration will be brought exclusively in the state or federal courts located in Island County, Washington, and you consent to personal jurisdiction in those courts.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
You and WellWhisker agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (“Dispute”) will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration will be conducted in Washington State or remotely by agreement.
CLASS ACTION WAIVER: You and WellWhisker agree that any Dispute will be brought solely in your or our individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.
Opt-out: You may opt out of this arbitration agreement by emailing hello@wellwhisker.app within 30 days of first accepting these Terms, with the subject line “Arbitration Opt-Out” and stating your full name and account email.
If any part of this arbitration section is found to be unenforceable, the rest will remain in effect, except that if the Class Action Waiver is found unenforceable, the entire arbitration section is void.
Severability. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and WellWhisker regarding the Service and supersede any prior agreements.
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Continued use of the Service after changes become effective constitutes acceptance of the new Terms.
